Newly released video shows moments leading to deadly March shooting involving off-duty officer at Summerville Chick-fil-A
SUMMERVILLE, S.C. (WCBD)- The South Carolina Law Enforcement Division (SLED) has released new videos showing the moments that led up to a deadly shooting at a Summerville Chick-fil-A in March.
Former Summerville Police officer Anthony DeLustro was indicted on murder and attempted kidnapping charges in connection with the March 20 death of Michael O’Neal outside the restaurant on North Main Street.
Affidavits provided by SLED show DeLustro was off-duty when he engaged in a confrontation with the victim.
Documents say DeLustro exited his vehicle and an altercation ensued.
Witnesses told authorities that DeLustro was the aggressor and said that after the two exited their vehicles, the victim asked the off-duty officer, “Do you want to do this?” several times, to which DeLustro replied, “Come on, you f*****g f****t.” Punches and kicks were then exchanged between the two.
Bystanders attempted to separate the two, but the men continued to exchange blows, cellphone video obtained by News 2 shows.
In a 911 call released Friday, a female caller can be heard telling first responders to “please hurry” as the men fought. Seconds later, the caller shouts: “A gun, a gun!”
At some point during the scuffle, DeLustro told O’Neal that he was under arrest and pulled his Summerville Police Department credentials from his back pocket, and presented them before they fell to the ground. DeLustro’s handgun also fell from his holster onto the pavement.
Bystander video shows O’Neal disengaging from the situation and walking back to his vehicle. A witness reportedly heard the victim say he wanted to leave.
Another witness who was restraining DeLustro heard the off-duty officer tell O’Neal that he would shoot him if he left. The video shows DeLustro break free and pick up the handgun from the pavement.
Moments later, a witness can be heard on video saying, “Oh my god he’s in the car.”
DeLustro opened the victim’s passenger side door and entered the vehicle while armed with his handgun. O’Neal told DeLustro to “get out of my car,” and began to drive away while DeLustro was still partially seated and fired a single shot from his gun.
O’Neal was shot and killed at the scene. Berkeley County Coroner Darnell Hartwell said O’Neal suffered a gunshot wound to the right arm that traveled to the chest.
Affidavits show that DeLustro acknowledged that he knew O’Neal was attempting to leave the area and that it was his own intent to stop him. He also admitted he never saw the victim with a firearm or another weapon, nor ever threatened to use a weapon of any kind.
DeLustro was denied bond in his initial court appearance. He is scheduled to have another bond hearing on July 15, according to Berkeley County court records.
