Former Summerville officer accused of murder in Chick-fil-A shooting granted bond
BERKELEY COUNTY, S.C. (WCBD) — A former Summerville officer accused of shooting and killing a man during an altercation outside a Chick-fil-A restaurant last March has been granted bond due to ongoing medical issues, according to court records.
Judge Roger Young ordered Monday that Anthony DeLustro, 64, can be released from jail on a $150,000 surety bond under certain conditions.
DeLustro will be placed on house arrest and only permitted to leave his home for medical, legal, and church visits. He must also get written permission from the court before seeking out-of-state medical treatment.
He will be required to wear an ankle monitor and surrender his driver’s license and passport.
Lawyers for DeLustro asked the judge last week to reconsider his bond, citing new medical issues that arose in the past six months — after his bond was initially denied.
His lawyers said their client had been injured in the head and had broken his ankle, and that he needed to be released to seek medical treatment.
Solicitor Scarlett Wilson said DeLustro was already getting the medical treatment he needed while in jail.
“While we opposed the result, we appreciate the expeditious ruling and the imposed conditions,” Wilson told News 2 after Young’s Feb. 24 ruling.
DeLustro was working off-duty on the afternoon of March 20, 2024, when authorities said he got into an altercation with Michael O’Neal at the Chick-fil-A on North Main Street in Summerville.
At some point during the scuffle, DeLustro told O’Neal that he was under arrest, pulled out his Summerville Police Department credentials from his back pocket, and presented them before the items fell to the ground, including DeLustro’s handgun which fell from his holster onto the pavement.
Bystander video shows O’Neal disengaging from the situation and returning to his vehicle. A witness reportedly heard the victim say he wanted to leave.
DeLustro followed O’Neal to his vehicle, opened the passenger side door, and attempted to get into O’Neal’s vehicle. Authorities said DeLustro then fired his weapon when O’Neal tried to drive away.
O’Neal was killed at the scene. Berkeley County Coroner Darnell Hartwell said O’Neal suffered a gunshot wound to the right arm that traveled to the chest.
